FREQUENTLY ASKED QUESTIONS ABOUT THE AQUA-LEISURE VOLUNTARY RECALL OF INFLATABLE BABY FLOATS ("BABY BOATS") There have been a number of media reports about the Aqua-Leisure voluntary recall announced jointly by the company and CPSC on July 2, 2009. Not all of these reports have been accurate. As a consumer, it is important to consult the official Consumer Product Safety Commission (CPSC) website for accurate information about this recall: http://www.cpsc.gov/cpscpub/prerel/prhtml09/09261.html. In cooperation with the CPSC, Aqua-Leisure is now clarifying several issues related to the recall, based on questions we have received. Frequently Asked Questions Question: Are all of Aqua-Leisure's Baby Boats being recalled? A: No. It is important to consult the official CPSC Press Release to determine which products are included in this recall. The recalled inflatable baby floats were sold in a variety of styles and colors as shown and described in the Press Release. A date between 08/02 and 07/08 is molded on the valves of recalled products. Products not included in the recall can be identified with the lettering “NP” molded on the valve. Question: Have there been any injuries? A: No. Fortunately, in each of the 31 incidents reported, when the seat strap failed, an adult was attending the child. As our packaging and labeling make clear, children should never be left in a baby boat without adult supervision. Question: Should I just throw out my product? A: No. First you should determine whether the product is covered by the recall by reviewing the CPSC Press Release. The Aqua-Leisure Call Center can assist you with this process if needed. To receive a refund for a product that is subject to the recall, you will need to cut out the material that contains the inflation valve AND the writing next to the valve (this material shows the Aqua-Leisure trademark and the copyright date). This serves two purposes: (1) it will render the product unusable by cutting the material so it cannot be inflated, and (2) it will allow Aqua-Leisure and CPSC to track important information about the recall. Question: What if I don't care about getting a refund? A: Even if you are not interested in receiving a refund, please render the product unusable by cutting the material so that it cannot be inflated. A: No. Aqua-Leisure is voluntarily conducting this recall in cooperation with the CPSC. Aqua-Leisure has been working with CPSC in preparation for the recall announced July 2, 2009. Question: Didn’t you recall baby boat products in 2001? A: Yes, but that recall took place for different reasons. In that case, we learned that one of our factories was not producing the “SunSmart” Baby Adjustable Sunshade Boat to the company’s specifications. Aqua-Leisure fired the factory and recalled all of the “SunSmart” Baby Adjustable Sunshade Boats manufactured there. Question: How are the 2009 products different from the products being recalled? A: The 2009 product line is not subject to this recall. Our 2009 product line, for various reasons unrelated to this recall, is constructed differently. Among other things, our 2009 product line was modified to comply with the new phthalate rules enacted by the U.S. Congress last year. As a result, our 2009 products are manufactured in an entirely different manner to entirely different specifications. Question: Does the product fail federal guidelines? A: There are no current federal guidelines for this type of product. Safety is one of Aqua-Leisure's primary concerns and the company is working to develop voluntary safety guidelines for all manufacturers of baby float products in the near future. * * * * |
